4 yearly review of modern awards –common issue –public holidays –Registered and Licenced Clubs Award 2010.
A. Further to the Full Bench decision issued by the Fair Work Commission on 18 April 2019 [ FWCFB 1369] the above award is varied as follows:
1. By deleting clause 29.3(c) and inserting the following:
(c) An employee other than a casual working on Christmas Day when it falls on a weekend,and is not prescribed as a public holiday under the NES,will be paid an additional loading of 50% of their applicable ordinary hourly rate for the hours worked on that day and will also be entitled to the benefit of a substitute day.
B. This determination comes into operation from 18 April 2019. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect until the start of the first full pay period that starts on or after 18 April 2019.
