Appeal against decision [2013] FWC 8575 of Deputy President Sams at Sydney on 31 October 2013 in matter number AM2012/235 - Determination.
A. Further to the Decision dated 20 December 2013, 1 the Fair Work Commission orders that Marine Tourism and Charter Vessels Award 2010 be varied as follows:
1. By deleting clause B.2.2(a),(b) and (c) and inserting the following:
B.2.2 Crew Level 2
(a) After completing the first three months of employment (probationary period) and upon the completion of the Introduction Deckhand Course or relevant experience/qualifications as determined by the employer,the employees’wage level will rise to that of the Crew Level 2 wage.
(b) Duties include all those of a Crew Level 1 employee,usually to a higher level of competence than a Crew Level 1 employee.
B. This determination comes into operation on the first full paid period commencing on or after 19 December 2013.
