Appeal against decision [2014] FWC 6416 of Senior Deputy President O’Callaghan at Adelaide on 18 September 2014 in matter number U2014/6909.

A. Pursuant to subsection 606(1) of the Fair Work Act 2009,the Fair Work Commission orders that part of the decision [[2014] FWC 6416] and order [PR555454] of Senior Deputy President O’Callaghan made at Adelaide on 18 September 2014,which arises from paragraph 65 of his decision,in matter number U2014/6909 be stayed in the terms set out below:

1. The amount of lost pay from the date of termination until the date of this order be deposited,by no later than 17 October 2014,into an interest bearing account controlled by the legal representative for Royal Bay International Pty Ltd [the appellant].

2. The amount of lost pay to be calculated using the appropriate classification under the Poultry Processing Award 2010 [MA000074].

3. In the event the appeal is dismissed the monies held by the legal representative of the appellant be paid directly to Mr Vannea [the respondent].

4. Liberty to apply to vary this order is granted to either party.

B. This order shall operate on and from 9 October 2014 until a decision in relation to the appeal is made or the Fair Work Commission makes a further order.
