4 yearly review of modern awards –Concrete Products Award 2010 –request for variation of directions.
[1] On 12 January 2015,Solicitors for the Concrete Masonry Association of Australia requested that Direction 2 made in respect of the Brickworks Limited proposed variations to the Concrete Products Award 2010 [MA000056] (the Award) to be varied to extend the date for the filing of submissions and evidentiary material in support until 27 February 2015.
[2] The Brickworks Limited proposed variations and the rationale advanced by Brickworks Limited for them was advised to the Fair Work Commission (the Commission) on 8 May 2014 and published on the Commission’s web-site in relation to the 4 Year Review of the Award on 12 May 2014. Directions for the hearing and determination of the proposed variations were made on 18 November 2014 (and varied on 4 December 2014 to add directions in relation to The Australian Workers’Union matters referred to the Full Bench in the Amended Directions of President Justice Ross of 18 November 2014),following a directions hearing at which the matters raised in the 12 January 2015 correspondence were considered. The Concrete Masonry Association of Australia was aware of the date for the filing of its submissions and evidentiary material from 6 November 2014 [Transcript,at para 159].
[3] The Full Bench is not persuaded that the directions should be varied on the basis indicated in the 12 January 2015 correspondence.
