A. Further to the decision [2022] FWC 1245 issued by the Fair Work Commission on 20 May 2022,the above award is varied as follows:
1. By deleting the words “shift penalty rates”appearing in clause 10.4 and inserting “shiftwork rates,weekend rates”.
2. By deleting clause 11.7(b) and inserting the following:
(b) by a regional daily newspaper or a suburban newspaper cannot be classified above Level 10.
3. By deleting the word “Penalty”appearing in the heading of clause 12.4 and inserting “Shiftwork and weekend”.
4. By deleting the words “shift penalty rates”appearing in clause 12.4(b) and inserting “shiftwork or weekend rates”.
5. By deleting clause 12.4(c) and inserting the following:
(c) The agreement may provide that one or more of the additional rates in clause 19—Shiftwork and weekend rates will not apply. In such a case,those additional rates will not apply.
6. By deleting the words “overtime and penalty rates”appearing in the Note in clause 14.1 and inserting “overtime,shiftwork,weekend and public holiday rates”.
7. By deleting the words “shift penalty rates”appearing in clause 16.2(b)(v) and inserting “shiftwork,weekend and public holiday rates”.
8. By deleting the words “Overtime and Penalty Rates”appearing in the heading of Part 5 and inserting “Overtime,Shiftwork and Weekend Rates”.
9. By deleting the words “shift penalty rates”appearing in the heading of clause 18.8(d) and inserting “shiftwork rates,weekend rates”.
10. By deleting the words “Shiftwork and weekend penalty rates”appearing in the heading in clause 19 and inserting “Shiftwork and weekend rates”.
11. By deleting clause 19.1 and inserting the following:
19.1 Morning and afternoon shifts
Subject to the provisions of clause 19,an employee who is instructed by the employer to perform and performs ordinary hours on a shift will be entitled to be paid an additional 10% of the ordinary hourly rate for all ordinary hours worked on a shift:
any part of which falls between the hours of 6.00 am and 7.00 am,or
(a) that concludes between the hours of 6.00 pm and 8.30 pm.
12. By deleting clause 19.2 and inserting the following:
19.2 Night shifts
Subject to the provisions of clause 19,an employee who is instructed by the employer to perform and performs ordinary hours on a shift,any part of which falls between the hours of 8.30 pm and 6.00 am,will be entitled to be paid the following additional rates for all ordinary hours worked on that shift:

13. By deleting clause 19.3 and inserting the following:
19.3 The additional rates provided in clauses 19.1 and 19.2 are not cumulative and,where any shift attracts both additional rates,the higher percentage additional rate only will be paid.
14. By inserting the word “additional”before the words “rates prescribed”appearing in clause 19.5.
15. By deleting the words “shift penalty rates”appearing in clause 19.6 and inserting “additional rates”.
16. By deleting the words “shift penalty rates and penalty rates”wherever they appear in clause 30.1(c) and inserting “shiftwork rates,weekend rates and public holiday rates”.
17. By deleting the words “penalties and overtime”in clause A.1.1 and inserting “shiftwork rates,weekend rates,public holiday rates and overtime”.
18. By inserting the following Note below the table appearing in clause A.1.3:
NOTE:The classification of editorial employees is limited in accordance with clause 11.7.

B. This determination comes into operation on 30 May 2022. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee's first full pay period that starts on or after 30 May 2022.
