Section 160 of the Fair Work Act 2009 (Cth) –variation on the Commission’s own motion –residual variations –Electrical,Electronic and Communications Contracting Award 2020.

A. Further to the decision issued by the Full Bench on 8 July 2022 [[2022] FWCFB 119],the above award is varied as follows:

1. By inserting the following definition in clause 2.3 in alphabetical order:

    ordinary hourly rate means the minimum weekly rate for an employee’s classification specified in clause 16.2,plus the industry allowance and any applicable additional all purpose allowances divided by 38”.

2. By deleting the word “themself”appearing in clause 18.6(a)(ii) and inserting “themselves”.

B. This determination comes into operation from 11 July 2022. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 11 July 2022.
