Section 160 of the Fair Work Act 2009 (Cth) –variation on the Commission’s own motion –residual variations –Cement,Lime and Quarrying Industry Award 2020.
A. Further to the decision issued by the Full Bench on 8 July 2022 [[2022] FWCFB 119],the above award is varied as follows:
1. By deleting clause 18.2(d) and inserting the following:
(d) First aid allowance
An employee:
(i) who has been trained to provide first aid;
(ii) who holds a current and appropriate first aid qualification (such as a certificate from St John Ambulance or similar body);and
(iii) who is appointed by the employer to act as a first aider
is entitled to the following first aid allowances which will be paid for all purposes:

B. This determination comes into operation on 11 July 2022. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 11 July 2022.
